Scrambles and Summits Terms and Conditions

These terms and conditions represent a legal agreement between the member ("You") and Scrambles and Summits ("SnS", "We", or "Us").

1. License to Use Site

SnS hereby grants you a non-exclusive, non-transferable, revocable license to use Scrambles and Summits (the "Site") in accordance with these terms and conditions and any guidelines or policies posted on the Site. SnS reserves the right to revoke or suspend, at its sole discretion, this license and to prevent you from accessing any or all of the Site without reason or notice and at no liability to SnS.

The Site and all content provided therein is protected by applicable intellectual property laws. The Site is provided for non-commercial use.

2. Privacy

You must provide SnS with personally identifiable information ("Personal Information") to become a member. We will use this information in the following manner:

We will use your contact information to notify you of important information with regards to operation of the Site.

We may use your Personal Information in aggregate to derive statistical information about the Site.

Should You so desire, certain Personal Inforation (such as your email address) may be made available to others through the Site for your own purposes.

We will not sell or otherwise provide your Personal Information to any third party, except (i) as part of a merger or aquisition or other legal restructuring of the Site, or (ii) as required by a valid judicial process.

3. Use of Publishing Tools

The Site provides You with tools that allow you to upload content ("Member Content") to the Site, and this Member Content may be published for others to see. In return for this service, you agree:

You shall not publish any Member Content that is unlawful, threatening, abusive, slanderous, obscene, or otherwise objectionable to others.

You shall not publish any Member Content that you do not have the legal right to publish.

All Member Content that You publish shall in no way infringe on the copyright or other property right of any other individual.

All Member Content published by You is of a non-commercial nature and does not represent advertising or any other manner of promotional material.

You shall not upload any executable computer code in any form that may cause damage or may limit the functionality of the Site or of the computers of any other users of the Site. This includes but is not limited to viruses, malicious script code, and denial of service code.

You shall not violate any valid local, national, or international law in your usage of the Site.

You shall not "stalk" or otherwise harass any other individual.

4. License to Use Member Content

All Member Content remains the property of the original author. By publishing Member Content to the Site, you grant SnS a worldwide, perpetual, irrevocable, transferable, royalty-free license to distribute, broadcast, modify, create derivative works of, and otherwise use the Member Content for any purpose and without any obligation to You or the original author.

5. Use of Member Content

Member Content is provided by the publishing Member (the "Publishing Member") "as-is", and no warranty is provided by SnS or the Publishing Member as to its accuracy or fitness for purpose or any other aspect.

Use of Member Content may involve risk, and you agree to use the Member Content or any other information provided by the Site at your own risk. You agree to hold SnS and the Publishing Member harmless for any damage or loss sustainted in using the Member Content or any other information provided by the Site.

6. Changes to This Agreement

SnS reserves the right to change the terms and conditions of this agreement at any time. Each time You use the Site, you are bound by the terms and conditions that are posted on the Site at your time of use.
